Can I claim real estate professional status?
Only if you meet both statutory tests: more than half of your personal services in trades or businesses during the year performed in real property trades or businesses, and more than 750 hours in them. Both must be documented contemporaneously. This is one of the most frequently examined positions in the Code, and it is lost far more often on the absence of a time log than on the underlying facts.
What is reasonable compensation for an S-corporation owner?
What a comparable employee would be paid for comparable work, which is a facts question rather than a percentage rule. The IRS examines this position regularly, and the defence is documentation: comparable salary data, a written analysis of duties and hours, and consistency between the salary and the distributions taken.
